ACLU Fights Wiretapping Approved by Obama, McCain and Bush
When Pres. George W. Bush and Sen. Barack Obama BOTH agreed on unconstitutional amendments to the foreign intelligence surveillance act (FISA) last week, it raised questions about Obama's consistency on civil liberties and about how to best fight this assault on the Fourth Amendment and the right to privacy. EFF Press Conference After NSA Wiretapping Court Hearing
http://www.eff.org/news/archives/2006_06.php#004761 The Electronic Frontier Foundation (EFF) told a federal judge today that the government should not be allowed to use the "state secrets privilege" to preempt the class-action lawsuit against AT&T. EFF's suit accuses AT&T of collaborating with the National Security Agency (NSA) in illegally spying on millions of Americans -- handing over customers' telephone and Internet records and communications without any legal authority. Department of Justice lawyers argued today that even if the NSA program is illegal, pursuing the case might expose "state secrets." However, EFF attorneys asked the judge to allow the case to proceed, considering the privilege in regards to specific evidence and situations instead of derailing the suit all together.

"In other words the President may break the law using amorphous Constitutional power as an excuse." "The top advisor to Senator McCain set the record straight in a letter posted online by the conservative National Review this week. [The top McCain advisor] wrote that McCain believes the Constitution gave President Bush the power to order the National Security Agency to monitor Americas international phone calls and e-mails without a warrant. This, despite a 1978 Federal statute that specifically required court oversight of such surveillance." "Furthermore, quoting him, 'neither the Administration not the telecoms need apologize for actions that most people except the ACLU and trial lawyers understand were Constitutiaonal and appropriate in the wake of the attacks on September 11, 2001.'" "As for McCain, himself, saying about six months ago, 'I don't think the president has the right to disobey a law. ' It's notable that in the very same interview, he also said, 'there are some areas where the statutes don't apply such as the surveillance of overseas communications.'"
